1. What you can do without special permission:
We have made the music available to preview via Real Audio and Quick Time along with the sole, limited and restricted right for "Your Company" (including you, your company and affiliated third party decision makers on projects managed by you and your company) to listen to the Individual Tracks to determine whether or not Your Company is interested in utilizing any of the Individual Tracks in specific productions. In other words, you can play or synchronize this music for in-house and Company presentations to clients to see how it works with your project.

2. What you can NOT do without special permission or paid license:
With the exception of the uses mentioned in the pervious paragraph, Your Company may not DISPLAY, TRANSMIT, DISTRIBUTE, broadcast, publish, synchronize, TEST MARKET, FOCUS GROUP or otherwise use these tracks without prior written consent in the form of an Individual Track Agreement (license).

3. If Your Company determines that it wishes to use any of the Individual Tracks, and upon Your Company's inquiry (in the form of a license application), subject to the availability of such Track(s) for the uses intended by Your Company as confirmed on the EM website, once Your Company pays in full the license fee set forth in such Individual Track Agreement, EM will grant to Your Company the non-exclusive, limited right to display, transmit, distribute, record, re-record, transcribe, broadcast, synchronize, telecast and otherwise use such Individual Track, (including the lyrics thereto if any), solely in the specific production set forth in such Individual Track Agreement, for the production, medium, term and territory according to the provisions set forth in such Individual Track Agreement.

4. THIS AGREEMENT ACCEPTED HEREWITH IS NOT AN INDIVIDUAL TRACK AGREEMENT OR LICENSE - THIS AGREEMENT IS A PRE-SCREENING COMPLIANCE AGREEMENT. YOUR COMPANY ACKNOWLEDGES THAT THE LICENSING OF EACH INDIVIDUAL TRACK IS SUBJECT TO AVAILABILITY AND THAT CERTAIN OF THE INDIVIDUAL TRACKS MAY BE RESTRICTED FROM USE WITH RESPECT TO THE SUBJECT MATTER OF YOUR COMPANY'S PRODUCTION AND/OR MEDIUM FOR YOUR COMPANY'S PRODUCTION. ALL SUCH RESTRICTIONS ARE POSTED ON THE WEBSITE'S SEARCH RESULTS PAGES NEXT TO THE AUDIO ICONS FOR EACH TRACK. THIS IS A LIMITED LICENSE. ALL OTHER RIGHTS ARE RETAINED BY EM.
